1. Awang Binting telah mengirim surat meminta penjelasan kepada Bank Negara Malaysia dan kemudian Bank Negara Malaysai menghantar surat balasan memberi penerangan kepada Awang Buntal durjana. Isi surat berkenaan menyatakan

2. Aktiviti GMSB mestilah tidak bercanggah dengan Akta Perbankan dan Institusi Kewangan 1989 (BAFIA), Akta Insurans 1996 dan Akta Perbankan Islam 1983. Ketiga2 akta ini ada menyentuh tentang hal yang sama iaitu mencegah >>> aktiviti pengambilan deposit secara haram. Sedangkan GMSB terang2an menjalankan aktiviti pengambilan deposit secara haram.

On Tuesday, Bank Negara carried out the raid at the company’s premises in Papar following complaints received from the public.

The company is being investigated under Section 25(1) Banking and Financial Institutions Act 1989 (BAFIA), which carries a fine not exceeding RM10 million or imprisonment for a term not exceeding 10 years or both, and Section 4(1) of Anti-Money Laundering and Anti-Terrorism Financing Act 2001 (AMLATFA), which carries a fine not exceeding RM5 million or imprisonment for a term not exceeding five years or both.

Untuk makluman semua forumer, Si Binting ni sebenarnya menjadi korban oleh orang2 pintar disekelilingnya seperti anak2 buahnya dan saudara mara beliau ( termasuk projek D ). Kalau sesiapa yang mengetahui tentang si Binting ni dia tu nak kesat hingus pun tak pandai sebab sekolah setakat darjah 6 aje.

Sekarang kononnya GM ni satu syarikat perkongsian keuntungan. Kalau betul macam tu buatlah permohonan kepada Bank Negara untuk ambil deposit awam tapi tak jugak di minta sebab memang tak dapat kerana niatnya untuk membuat penipuan awam.

Satu perkara yang amat nyata sekali ialah kepada penyimpan disana saya mau tanya adakah kamu diberikan buku akaun atau slip bayar/terima wang kamu disana. Kalau tak ada macamana kamu boleh buang duit kamu begitu banyak disana tanpa sebarang bukti penyimpanan.

I cant think of anything else of what is more appropriate action of BNM than asking Mua Buntal to refer his ponzi concept to the Domestic Trade and Consumer Affairs Ministry. The sales of any products surely under jurisdiction of this ministry as Gemilang Mirza Sdn. Bhd. isn’t a financial company, neither it is a security company.

Investment firm boss threatens to sue BNM

Kota Kinabalu: Gemilang Mirza Sdn Bhd (GMSB) Managing Director Ag Binting Pg Salleh insisted Friday that his company is running a legal business and will take legal action against Bank Negara Malaysia (BNM) for Wednesday’s raid on his Papar office.

He claimed to have necessary documents to prove that relevant government agencies had supported his business.

“Being the founder, the GMSB is running its business legitimately,” he told reporters, Thursday.

BNM raided the GMSB office on suspicion of illegal collection of deposits and money laundering following public complains. Relevant assets and documents were seized for investigations.

The raid was conducted under section 25(1) of the Banking and Financial Institution Act 1989 (BAFIA) and section 4(1) of the Anti-Money Laundering and Anti-Terrorism Financial Act 2001 (AMLATFA).

Section 25(1) of the BAFIA 1989 prohibits any person from receiving, taking or accepting deposits without having a valid license while section 4(1) of AMLATFA 2001 prohibits any person from engaging in, or attempting to engage, or abetting the commission of the money laundering activities.

According to Ag Binting, thousands have benefited from GMSB’s profit sharing concept and none had complained of not receiving dividends since his company began operations.

He reiterated that his company’s activities mainly revolved around producing its own brand of produce and the people were investing jointly on “a profit sharing concept”.

Last year Ag Binting told Daily Express in an interview that GMSB reaped profits of between 50-60 per cent from the sale of their products and Ag Binting said his investors enjoyed profit sharing of between 10-12pc every month.

Ag Binting claimed that at one time GMSB had about 30,000 investors.

However, along the way the number reduced to 25,000.

On the amount, he said people were investing in the region of anywhere from RM5,000 to RM50,000. On how much GMSB had collected from investors, he revealed it was in the region of up to RM3 million.

However, he declined to reveal the amount of money that was reported missing in GMSB’s bank account. He had lodged a report at the Papar police station last Sunday about the missing money.

He said the missing money was an internal matter involving his family and that the case was considered closed.

On how he would face his investors since BNM had frozen all his bank accounts as well as properties, Ag Biniting said he urged all his investors to be clam, patient and understand the situation and problem he faced now.

“After BNM had completed their investigations I promise to find a way to pay back the investors,” he said, showing a book containing signatures of his investors expressing support for him and GMSB.

Biar kadiaku memperkenalkan satu perkataan undang2 kepada Awg Binting sbg pendidikan kpd bakas konduktor bas ani. Perkataan atu ialah “subjudice”.
Maksud Subjudice: while a matter is under judicial consideration newspaper comment on the case is prohibited because the matter has not yet been decided by the Court and is still debatable.

Ujian akan terus dihadapi selagi melakukan perniagaan tanpa mengikut saluran..Banyak syarikat seperti ini mengambil deposit org ramai dengan kata kata ingin membantu sesama insan,tetapi bila diambil tindakan menyalahkan bank negara dan kerajaan kerana mengambil tindakan..
Bagi sayalah , kalau betul hendak meniaga dan ada idea perniagaan yang cantik dan berhasrat ingin membantu ummah, kenapa tidak mengikut saluran yang betul..ikut undang undang malaysia tubuhkan KOPERASI..memang boleh ambik deposit..takde BNM nak serbu..tapi lkalau ambik deposit guna nama syarikat memang lah kena..dah de peraturan macamtu..kalau tak macammana kita nak bezakan penipu dgn bukan penipu..semua org bukak syarikat, ambik deposit, lepas tu lari..pelabur gak yang jadi mangsa..
apakah agenda sebenar membuka syarikat untuk ambik deposit orang awam? adakah untuk memperkayakan ummah atau memperkayakan diri sendiri? jalan yang lurus dah ada (dgn tubuhkan koperasi ) kenapa pilih jalan yang bengkok?
fikir fikirkanlah!!!

bagi lah peluang utk mereka membetulkan kesilapan mereka(GM)..klu GM hidup semula..hidup juga harapan petani2 yg melabur, mereka yg buat pinjaman, mereka yg gadai tanah dan sebagainya..urg yg berilmu yg berpengalaman luas dalam perniagaan bantulah mereka..tapi klu yg dengki dan sakit hati mereka tetap jg mahu bumiputera ini jatuh..

Firm: Funds have gone missing

Kota Kinabalu: A Papar-based company involved in an investment scheme has asked police to investigate the disappearance of funds from their bank account.

Papar Police Chief, DSP Nek Zaidi Zakaria confirmed a report was lodged by Gemilang Mirza Sdn Bhd Managing Director Ag Binting Ag Salleh last Sunday.

However, he declined to elaborate, pointing out that investigations have been handed over to the Commercial Crime Investigation Department.

Gemilang Mirza is an investment firm that adopts a business partnership concept, with investors receiving monthly share profits through sales of their own brand of products, Ag Binting said in a Daily Express report last year.

BNM raid Papar investment firm

Kota Kinabalu: Bank Negara Malaysia (BNM) has raided the premises of a so-called investment scheme firm, Gemilang Mirza Sdn Bhd, in Papar, on suspicion of illegal collection of deposits and money laundering activities.

According to a statement, BNM stormed the company’s premises, Tuesday, following public complaints. Relevant assets and documents of the company were seized for further investigations.

The raid was conducted under Section 25(1) of the Banking and Financial Institutions Act 1989 (BAFIA) and Section 4(1) of the Anti-Money Laundering and Anti-Terrorism Financing Act 2001 (AMLATFA).

Section 25(1) of the BAFIA 1989 prohibits any person from receiving, taking or accepting deposits without having a valid license while Section 4(1) of AMLATFA 2001 prohibits any person from engaging in, or attempting to engage in, or abetting the commission of money laundering activities.

A person or company found guilty under Section 25(1) of Bafia would be fined not more than RM10 million or jailed not more than 10 years, or both.

On the other hand, the guilty party under Section 4(1) of AMLATFA will be handed a fine not exceeding RM5 million or imprisoned not more than five years, or both.

“The public are advised to be cautious of investment schemes promoted in the Internet, through phone calls or seminars by individuals or companies not licensed or authorised by BNM to accept deposits or to conduct foreign currency dealings,” the statement said.

A list of all licensed institutions authorised to accept deposits is available on BNM’s website at http://www.bnm.gov.my.

Consumer Association of Sabah and Labuan (Cash) Datuk Patrick Sindu recently criticised BNM for not taking serious action against those involved in get-rich-quick schemes in Sabah.

He said it was an open secret that in areas like Beaufort and here, companies have been collecting cash from the public purportedly as investment with the promise of dividends or profits on weekly or monthly basis.

Investment firm boss threatens to sue BNM

Kota Kinabalu: Gemilang Mirza Sdn Bhd (GMSB) Managing Director Ag Binting Pg Salleh insisted Friday that his company is running a legal business and will take legal action against Bank Negara Malaysia (BNM) for Wednesday’s raid on his Papar office.

He claimed to have necessary documents to prove that relevant government agencies had supported his business.

“Being the founder, the GMSB is running its business legitimately,” he told reporters, Thursday.

BNM raided the GMSB office on suspicion of illegal collection of deposits and money laundering following public complains. Relevant assets and documents were seized for investigations.

Last year Ag Binting told Daily Express in an interview that GMSB reaped profits of between 50-60 per cent from the sale of their products and Ag Binting said his investors enjoyed profit sharing of between 10-12pc every month.

Ag Binting claimed that at one time GMSB had about 30,000 investors.

However, along the way the number reduced to 25,000.

On the amount, he said people were investing in the region of anywhere from RM5,000 to RM50,000. On how much GMSB had collected from investors, he revealed it was in the region of up to RM3 million.

However, he declined to reveal the amount of money that was reported missing in GMSB’s bank account. He had lodged a report at the Papar police station last Sunday about the missing money.

He said the missing money was an internal matter involving his family and that the case was considered closed.

On how he would face his investors since BNM had frozen all his bank accounts as well as properties, Ag Biniting said he urged all his investors to be clam, patient and understand the situation and problem he faced now.

“After BNM had completed their investigations I promise to find a way to pay back the investors,” he said, showing a book containing signatures of his investors expressing support for him and GMSB.

Selain itu, melalui laporan akhbar yang disiarkan pihak media terbabit telah menggambarkan atau mendakwa bahawa siasatan tersebut dijalankan akibat daripada aktiviti berunsurkan skim cepat kaya telah dijalankan oleh Koperasi Taqwa Malaysia Berhad.Ambil perhatian bahawa Koperasi Taqwa Malaysia Berhad dengan ini MEMBERI NOTIS bahawa sehingga ke tarikh penyataan ini dibuat, Koperasi Taqwa Malaysia Berhad TIDAK PERNAH menerima sebarang notis dari mana-mana pihak berkuasa dan/atau TIDAK ADA sebarang arahan rasmi yang dikeluarkan berkenaan dengan pembekuan akaun Koperasi atau arahan untuk penggantungan segala aktiviti Koperasi atau tindakan perlucutan jawatan Ahli Lembaga Pengarah Koperasi yang dilantik.

Koperasi juga telah membuat satu laporan polis di Balai Polis Sentul, Kuala Lumpur pada hari ini (18.12.08) diatas dakwaan palsu tersebut dan seterusnya meminta pihak media yang bertanggungjawab memohon maaf secara terbuka kepada kami.

AMBIL PERHATIAN bahawa pihak koperasi memandang serius segala dakwaan yang telah disiarkan kerana ianya telah memberi impak yang besar dan negatif terhadap koperasi dan juga pengurusannya, dan juga menyebabkan terjejasnya aktiviti perniagaan koperasi pada masa ini. Malah ianya juga telah menimbulkan rasa panik dan kekhuatiran serta salah tanggapan kepada anggota-anggota kami.

Maka pihak pengurusan Koperasi Tawa Malaysia Berhad dengan ini memberi NOTIS supaya menghentikan segala dakwaan palsu dan tidak benar tersebut, dan tindakan undang-undang juga akan diambil kepada mana-mana pihak yang ingkar dan juga pihak yang telah menyebarkan kenyataan palsu dan tidak benar tersebut.

Bank Negara Malaysia Membuat Serbuan Terhadap Gemilang Mirza Sdn Bhd yang Disyaki Menjalankan Aktiviti Pengambilan Deposit Tanpa Lesen dan Pengubahan Wang Haram

Pada 13 Januari 2009, Bank Negara Malaysia membuat serbuan terhadap Gemilang Mirza Sdn Bhd di bawah Seksyen 25(1) Akta Bank dan Institusi-Institusi Kewangan 1989 (BAFIA) dan Seksyen 4(1) Akta Pencegahan Pengubahan Wang Haram dan Pembanterasan Pembiayaan Keganasan 2001 (AMLATFA). Seksyen 25(1) BAFIA 1989 melarang mana-mana individu untuk mendapat, mengambil atau menerima deposit tanpa lesen yang sah, sementara Seksyen 4(1) AMLATFA 2001 menghalang mana-mana individu daripada terlibat dalam, atau cuba untuk melibatkan diri dalam, atau bersubahat dengan aktiviti pengubahan wang haram.

Serbuan terhadap Gemilang Mirza Sdn Bhd dibuat di premis syarikat di Papar, Sabah berikutan aduan yang diterima daripada orang ramai. Aset dan dokumen syarikat yang berkaitan telah dirampas untuk tujuan penyiasatan.

Mana-mana individu atau syarikat yang melakukan kesalahan di bawah Seksyen 25(1) BAFIA 1989 akan, atas sabitan, dikenakan denda tidak melebihi RM10 juta atau dipenjarakan untuk tempoh tidak melebihi sepuluh tahun atau kedua-duanya sekali. Mana-mana individu atau syarikat yang melakukan kesalahan di bawah Seksyen 4(1) AMLATFA 2001 akan, atas sabitan, dikenakan denda tidak melebihi RM5 juta atau dipenjarakan untuk tempoh tidak melebihi lima tahun atau kedua-duanya sekali.

Orang ramai diingatkan supaya berwaspada dengan skim pelaburan yang dipromosikan melalui Internet, telefon atau seminar yang dianjurkan oleh individu atau syarikat yang tidak dilesenkan atau dibenarkan oleh Bank Negara Malaysia untuk menerima deposit atau berurusan dalam urus niaga mata wang asing, bagi mengelakkan kehilangan wang mereka. Senarai semua institusi berlesen yang dibenarkan menerima deposit terdapat di laman web Bank Negara Malaysia di www.bnm.gov.my.

20 usahawan luar bandar terima RM400,000 bantuan dari kerajaan

5th November, 2008 KOTA KINABALU: Seramai 20 usahawan luar bandar dari seluruh daerah Sabah telah menerima RM400,000 bantuan dari kerajaan untuk memulakan perniagaan secara kecil-kecilan.

Usahawan yang terpilih menerima bantuan maksima RM20,000 seorang itu di bawah Kementerian Pembangunan Luar Bandar dan Wilayah (KPLBW) itu telah berlangsung baru-baru ini.

Penolong Pengarah Kemajuan Masyarakat (Kemas) Wan Assim Bin Wan Shekh memberitahu wartawan New Sabah Times semasa majlis penutupan Kursus Latihan Bimbingan Usahawan Zon Sabah di Borneo Paradise Beach Hotel kelmarin.

“Dua puluh usahawan yang terpilih dari seluruh daerah Sabah menerima bantuan itu untuk memulakan perniagaan atas bidang perniagaan yang mereka ceburi,” kata Wan Assim.

Kemas telah mengadakan kursus dan berjaya melahirkan berpuluh ribu orang usahawan tempatan terutama mereka yang berasal dari kawasan luar bandar sejak Kemas ditubuhkan pada tahun 1961.

Kerajaan melalui KPLBW akan terus memberi bantuan kepada usahawan yang ingin menceburkan diri dan berjaya dalam bidang keusahawanan dan perniagaan dan keutamaan akan diberkan kepada mereka yang menamatkan pelbagai kursus yang dianjurkan oleh Kemas.

Beliau berkata kemas mengadakan kursus latihan bimbingan usahawan dua kali setahun bertujuan untuk memberi galakan kepada usahawan luar bandar meneceburi bidang perniagaan.

“Bantuan yang diberikan oleh kerajaan bertujuan untuk memperbaiki kehidupan dan pendapatan usahawan luar bandar,” kata Wan Assim.

Dalam ucapannya Wan Assim memberi ga-lakan kepada peserta yang menyertai kursus itu supaya menggunakan pengetahuan yang dipelajari dari kursus yang mereka hadiri dan mengambil tindakan selanjutnya.

“Usahawan luar bandar harus berani menerima cabaran dan mempromosikan produk mereka di pasaran dalam dan luar negeri,” tambah Wan Assim.

Pelbagai jenis kursus dan latihan yang dikendalikan oleh Kemas antara lain ialah kursus menjahit, memproses makanan, kelas menjahit dan lain-lain.

Seramai 48 usahawan lelaki dan wanita termasuk mereka yang sedang dalam latihan kemas menghadiri kursus latihan bimbingan usahawan berkenaan.

No price cuts in Sabah supermarts

Kota Kinabalu: Prices of consumer items in supermarkets here have not dropped despite the Government’s call on traders to lower prices in line with the decrease in the national and global oil prices.

On Tuesday, the Giant chain of hypermarkets in the peninsula was among the first to heed to the Government’s call when it reduced prices of some 1,200 items, including groceries, fresh food items and essential goods by up to 30 per cent.

However, checks at supermarkets here indicated many had yet to lower prices. When Daily Express visited a supermarket in Kolombong, its Manager refused to be drawn into discussing the matter.

He only mentioned that he was under strict instruction from management in Kuala Lumpur not to speak to reporters or give any information regarding the matter without their prior consent. A check with the other two main hypermarket market chains operating here also showed many items were still sold at the same price range as during the period when their prices were first raised.

Rice sold at these hypermarkets, for example, although being sold below the recommended retail price, was still much higher than it was before the oil price escalation and the subsequent price hike of the item.

The Cap Anggur brand’s recommended retail price listed was RM28 for a 10kg pack, but was sold at RM25.50, which is RM2.50 lower than the recommended retail price.

However, compared with the RM19.50 price tag of the same brand and pack back in June this year, the price remains high.

Another item – instant noodles – which has become a necessity for many in these trying times, are also still sold in the same price range as when its prices were raised.

A popular brand of the item, which cost between RM3 and RM3.50 for a pack of five packets before the price hike, is now sold for between RM3.90 and RM4.80 depending on the “flavour”.

At another local supermarket, the Daily Express was matter-of-factly told that most of the items sold were imported products, hence the reason why their prices have not gone down.

A store manager said: “Our prices carry a certain percentage of mark-up because 70 per cent of our items are imported products from various countries like the UK, Australia and America.”

Meanwhile, several sundry shops operators said that they would consider cutting prices if the manufacturers and the suppliers lowered theirs.

One of them, who operates in Kepayan said unless this happens, they had no choice but to continue selling their goods at the current prices, adding that all quarters must shoulder the responsibility.

The Government had in June increased oil prices by 78 sen for petrol, from RM1.92 to RM2.70 but has since been rolled back by 40 sen – 15 sen in August, 10 sen in September and 15 sen, this month (October).

Prices of goods, however, have not mirrored the decrease in oil prices, prompting the Government to urged not only hypermarkets but also suppliers and merchandisers to lower the prices of their products.

Kota Kinabalu: The Sabah Scrap Metals Recycle Association (SSMRA) regrets the State Local Government and Housing Ministry’s failure to provide it with a guideline on business procedures with Sabah’s sole exporter of scrap metal, Superpanel Sdn Bhd.

Its President, Jennifer Hiew, said with the deadline on the implementation of the new policy on scrap metal on Nov. 1, members have yet to be given any details about Superpanel.

Superpanel, a newly established Government-linked Company (GLC) is a wholly-owned subsidiary of the Sabah Housing and Town Development Authority (SHTDA).

It was appointed as the sole exporter of scrap metals and recyclables in the State following a State Cabinet decision on Aug. 6, this year, as a measure to resolve the serious metal thefts in the State.

A directive was issued to all local authorities in the State on Sept. 26 instructing them to stop renewing existing trading licences and against issuing new ones.

Effective Nov. 1, applicants for scrap metal trading licence must first be registered with Superpanel which also has the power to approve.

“But with only one day before the Nov. 1 deadline, the Ministry has not given us a proper guideline on how we are supposed to work with Superpanel.

“Yet they have proceeded to stop the renewal of our trading licence which has indefinitely put us out of business,” she said in a statement.

According to her, many members were forced to cease operations after they received the notification on Oct. 22, informing them of the Ministry’s directive.

The members “were not only furious but were also upset” because Superpanel could not provide any information about the company’s setup and operating procedure.

Superpanel, during a meeting with SSMRA arranged by City Hall Director-General Datuk Dr Chua Kim Hing Oct. 28, said it was still waiting for instructions from the Local Government and Housing Minister on how to go about dealing with scrap metal dealers.

According to Jennifer, the move to appoint a sole exporter was monopolistic, unfair, cruel and inhumane and contradicted the caring image of the Barisan Nasional (BN).

“The BN Government like any caring government around the world, should by right, strive to assist legitimate businesses during the current economic crisis and depression instead of depriving us at the expense of a privileged few,” she said.

She said the action has far-reaching implications on society as a whole as the majority of those involved in the scrap metal trade are poor and still servicing bank loans.

She claimed the Ministry’s rationale that the sole exporter move was aimed at stopping metal thefts in the State does not hold water and was questionable.

“Can the company (Superpanel) guarantee there will be no more metal thefts after it starts operating?” she asked.

She regretted that the Ministry proceeded with its decision despite strong objections from industry players who had shown their commitment through the establishment of the SSMRA and the “19-points proposals” on how to tackle the thefts.

The SSMRA, she said, questioned the Ministry’s motive for the Superpanel to take full control in the export of scrap metals and other recyclables in the State.

She hoped Chief Minister Datuk Seri Musa Aman would intervene. “If all avenues are exhausted, the association will be considering seeking legal means to address the matter.” The association has 46 members statewide.
